GENERAL

SMILE BOOKER is a health tourism promotion agency (hereinafter referred to as SMILE BOOKER) owned by the company Smile booker d.o.o. , specialized in mediation for connecting patients interested in dental services, dental clinics and other health tourism providers. The company performs its services in mediation and promotion through a specialized Web portal, which enables searching and scheduling appointments. All clinics advertised on the portal have all the necessary licenses issued by the competent authorities for the provision of the advertised services.

The business philosophy of the company is to provide patients who come to Croatia with services in dental and health tourism, as well as to ensure easy finding of the best and highest quality services and mediation with clinics.

The offer available through the Web portal is considered accepted at the moment when the advance payment of 15% is paid and these general conditions are accepted.

SMILE BOOKER acts only as an intermediary and will only be responsible as an intermediary.

At the date of booking, the service contractor must be at least 21 years of age.



HEALTH TOURISM SERVICES

All the services listed on the SMILE BOOKER website, as well as offers including prices, treatment plan, etc., are informative and serve the purpose of informing the potential patient as accurately as possible. The recipient and/or the patient can obtain accurate information at the first examination at the clinic, based on the specific therapy or intervention required.

Services that can be booked online at www.smilebooker.com fall into different areas of the classification: dentistry, orthodontics, rejuvenation treatments, etc. In order to simplify search process, health services are uniform for all clinics. Search filters and service selection filters provide short descriptions for each service and images. When a particular clinic provides additional benefit to its patients in the form of higher quality materials, procedures or expertise that differ from usual or statutory practice, it emphasizes the same in the clinic's profile under the option: "DESCRIPTION".



RESERVATION OF APPOINTMENTS

Reservation of appointments via SMILE BOOKER is made by entering a time range of 2 days within which the availability is searched. After selecting the right offer and making a 15% advanced payment, SMILE BOOKER sends an e-mail to the client confirming that a reservation request has been received. When the clinic accepts the appointment, a final confirmation email is sent to the client with information about the exact date of the first examination, the exact location of the clinic and the contact, services and procedures covered by the offer.

Some services require more than one arrival, and in some cases up to a few months may be required for the final procedure. The SMILE BOOKER is used to book the first date of a physical examination, while subsequent clinic visits are arranged directly with the clinic, depending on the specifics of the particular procedure and the patient.



PRICES AND PAYMENT DETAILS

Unless otherwise stated, all prices are in Kuna (Croatian Kuna) per service, while the advertised price in Euros is indicative and informative only. All credit card transactions are made in kunas. There may be a difference in the amount charged in Euro due to the difference in the exchange rate between the official rate and the course of the credit institution of the guest. SMILE BOOKER cannot be held responsible for exchange differences or fees of other banking institutions.

SMILE BOOKER publishes the prices of services which are determined solely by the clinics, whereas it implies that it is solely responsible for them as a mediator. All the prices that are provided as a quote by filter entry are indicative and refer explicitly to the selected services. During the physical examination it is possible to identify the need for additional procedures, which can increase the final price. All additional services recommended at the on-the-spot physical examination at the clinics are agreed directly with the clinic.

The offer is considered accepted by the patient after the advance payment of 15% is made; when the appointment is confirmed by the clinic, the appointment is finally booked. These general conditions are also accepted by making an advance payment. The rest of the price of 85% stated in the offer, as well as any additional interventions agreed at the clinic are paid directly at the cash desk at the clinic, where the final bill is issued.

Advance payment (15%) paid via SMILE BOOKER can be paid by: direct IBAN payment using the payment details from the offer (bank transfer), by PayPal, or credit cards:

  • Visa

  • Diners

The rest of the payment (85%) should be paid after the performed procedures directly at the clinic, using the means of payment supported by the clinic, which are indicated on the clinic's profile.

COMPLAINTS, CHANGES AND CANCELLATION

The accepted offer may only be cancelled electronically (via e-mail). Cancellation shall only apply from the day on which SMILE BOOKER receives the cancellation.

In case of cancellation of the accepted term up to 15 days before the date of the physical examination, the client is entitled to a refund of 50% of the advance payment.

In case of cancellation of the accepted term less than 15 days before the date of the physical examination, the patient is not entitled to a refund of the advance payment.

In the event that the clinic cancels the appointment for some reason, SMILE BOOKER undertakes to provide the client with scheduled appointments at an alternative polyclinic at the most similar prices and quality.

Customer complaints are received by mail at info@smilebooker.com and responded within 24 hours.



LOWEST PRICE GUARANTEE

SMILE BOOKER guarantees its customers that on the official website of the company www.smilebooker.com are indicated the lowest service prices for individual providers, that is, the same service cannot be found advertised at lower prices than ours.

The lowest price guarantee does not apply if the difference in price is due to a rise in taxes or fees, or significant changes in the exchange rate. It is also not applicable if the lower prices on other websites are not up-to-date and cannot be booked and in the case of special last-minute actions. The lowest price guarantee is only applicable at the time of booking and cannot be applied subsequently, i.e. after the reservation has already been made and paid for.



TECHNICAL DIAGNOSTIC EQUIPMENT OF SERVICE PROVIDERS - POLYCLINICS

All the clinics advertised on the Web site were personally inspected by the SMILE BOOKER staff in order to determine the quality of the equipment and the professional staff of the service provider. The service providers possess the up-to-date technical equipment for the services they offer, as well as all legally required certificates for performing advertised activities.

If the Service Provider provides the above statutory techniques or materials, the same is emphasized in the clinic's profile area - DESCRIPTION.



SMILE BOOKER ACTING AS AN INTERMEDIARY

SMILE BOOKER is a promotion agency providing brokerage services for scheduling medical appointments with health tourism clinics and does not own or provides healthcare services. By concluding a contract with SMILE BOOKER, the clinics have undertaken to provide truthful and complete information about their services, therefore they bear full responsibility to the recipient of the service. If contrary to expectations of SMILE BOOKER, the appointment booking process cannot be completed for reasons beyond the control of SMILE BOOKER as an intermediary (e.g. flagrant breach of the Business Cooperation Agreement), SMILE BOOKER is authorized to cancel the reservation, and the advance payment already paid by the recipient of the service will be refunded to him without delay. As an alternative and based on the choice of the recipient of the service, SMILE BOOKER may offer the recipient of the service a second offer of the same quality for the same price.



USER CONDUCT

The user is obliged to use the Website www.smilebooker.com exclusively in accordance with the regulations of the Republic of Croatia, as well as with basic ethical principles. Users may not post and transmit through this Website any material that threatens or in any way violates the rights of others, any material that is unlawful, threatening or abusive, defamatory, invasive or threatening to privacy, which is vulgar, obscene or otherwise objectionable in reasoned communication, which encourages unlawful activities and which, without the express, prior written permission of SMILE BOOKER, contains advertising or offers of any other products and services. Any user behavior that, at the discretion of SMILE BOOKER, restricts or disables any other user from using the Website www.smilebooker.com , is strictly forbidden. The user must not use the Website www.smilebooker.com for advertising or performing any commercial, religious, political or non-commercial publicity without the prior consent and signed contract with Smile booker d.o.o.

When using the Website www.smilebooker.com and its individual functionalities, SMILE BOOKER may collect certain personal information of the User and process and store them for the intended purpose.

By using the Website www.smilebooker.com you agree to the publicly disclosed privacy policies and acknowledge that you have read, understood and accepted the SMILE BOOKER privacy policies.

SMILE BOOKER reserves the right at any time to modify or discontinue any business segment, availability time, content and equipment required to access or use the Website, data transfer speed and any other features of the Website.

SMILE BOOKER reserves the right at any time and without prior consent to terminate or modify any of the general terms and conditions set forth herein.

EXTRAORDINARY EVENTS

In case the Reserved Service cannot be fulfilled or its fulfilment becomes significantly more difficult due to force majeure (e.g. war, natural disaster, ecological disaster, epidemics, border closure, strike and similar force majeure) which could not have been foreseen when scheduling an appointment, SMILE BOOKER and the service provider (clinic) may terminate the appointment scheduling as neither SMILE BOOKER nor the service provider can be held responsible in the above cases.



FINAL PROVISIONS AND COMPETENCES

  • SMILE BOOKER will not be held responsible for any error, omission or inaccuracy in the written confirmation.

  • Via this website, SMILE BOOKER transmits all information about polyclinics and strives to provide as accurate and up-to-date information as it can collect from their owners. The sole responsibility for providing accurate and complete information about the clinic and the services it offers lies with the owner of the clinic, and SMILE BOOKER cannot be held responsible in the case of incorrect, incomplete or incorrect information.

  • Any business use of information or logos posted on the Website www.smilebooker.com including any partial or complete reproduction constitutes copyright infringement and is prohibited by law.

  • The entire content, layout and design of the website www.smilebooker.com are protected by copyright law. Any copying, editing, saving or translation of the content, especially graphics, pictures, text or parts thereof is not permitted without the Smile booker's written authorization.

  • These General Terms and Conditions are compiled in Croatian and translated into English, Italian and German language by a certified court interpreter. In case of a doubt regarding the interpretation of particular terms in the translated version of these General Terms and Conditions, the original Croatian-language version shall be taken into account.

  • The Contracting Parties shall endeavour to settle any dispute in a responsible and consensual manner. In case of any dispute, the local jurisdiction of the competent court in Rijeka and the application of Croatian law are agreed.
